Terms of Service

1. Acceptance of Terms

By accessing or using Boottify's white-label development platform hosting services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

These Terms constitute a legally binding agreement between you ("User", "you", or "your") and Boottify ("Company", "we", "us", or "our").

2. Description of Services

Boottify provides white-label development platform hosting on Kubernetes infrastructure, including:

  • Isolated tenant workspaces with custom domain support
  • Container orchestration and deployment automation
  • GitHub integration and CI/CD pipelines
  • SSL certificate management via Let's Encrypt
  • Database hosting and backup services
  • White-label branding capabilities

3. Account Registration

3.1 Eligibility

You must be at least 18 years old and capable of forming a binding contract to use our Services. By registering, you represent that you meet these requirements.

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Using strong passwords and enabling two-factor authentication

3.3 Account Information

You agree to provide accurate, current, and complete information during registration and to update this information as necessary.

4. Acceptable Use

4.1 Permitted Use

You may use our Services only for lawful purposes and in accordance with these Terms. You agree to use the Services for legitimate software development and hosting activities.

4.2 Prohibited Activities

You agree NOT to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Distribute malware, viruses, or harmful code
  • Engage in cryptocurrency mining without authorization
  • Host content that is illegal, defamatory, or obscene
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Services or other users
  • Use the Services for spam, phishing, or fraudulent activities
  • Resell or redistribute Services without authorization
  • Exceed allocated resource quotas or abuse fair use policies

5. Billing and Payment

5.1 Subscription Plans

Services are offered under various subscription plans. Plan details, pricing, and features are available on our pricing page and may be updated from time to time.

5.2 Payment Terms

  • Fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as specified in our refund policy
  • We accept payment via credit card and other methods as indicated
  • You authorize us to charge your payment method automatically

5.3 Late Payment

If payment fails or is overdue:

  • We may suspend access to Services after 7 days
  • We may terminate your account after 30 days
  • Late fees of 1.5% per month may apply

6. Service Level Agreement

6.1 Uptime Commitment

We strive to maintain 99.9% uptime for production environments. Scheduled maintenance windows are excluded from uptime calculations.

6.2 Support

Support response times vary by subscription plan:

  • Basic: Email support within 48 business hours
  • Pro: Priority email support within 24 business hours
  • Enterprise: Dedicated support with 4-hour response time

7. Data and Content

7.1 Your Data

You retain all rights to your data, code, and content. By using our Services, you grant us a limited license to host, store, and process your data as necessary to provide the Services.

7.2 Backups

We perform daily automated backups with 7-day retention. You are responsible for maintaining additional backups of critical data.

7.3 Data Export

You may export your data at any time through our platform tools or by contacting support.

8. Intellectual Property

8.1 Our Property

The Boottify platform, including its software, design, documentation, and trademarks, is our exclusive property protected by intellectual property laws.

8.2 License to Use

We grant you a limited, non-exclusive, non-transferable license to use our Services during your subscription term.

8.3 Your Property

You retain ownership of all code, applications, and content you create using our Services.

9. Termination

9.1 By You

You may terminate your account at any time through account settings or by contacting support. Termination takes effect at the end of the current billing period.

9.2 By Us

We may suspend or terminate your account if you:

  • Violate these Terms or our Acceptable Use Policy
  • Fail to pay fees when due
  • Engage in activities that harm our platform or other users

9.3 Effect of Termination

Upon termination:

  • Your access to Services will be disabled
  • Your data will be retained for 30 days, then permanently deleted
  • Outstanding fees remain payable

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or completely secure.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim
  • We are not liable for data loss, business interruption, or lost profits

12. Indemnification

You agree to indemnify and hold harmless Boottify and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you host on our platform

13. Governing Law and Disputes

These Terms are governed by the laws of Lithuania. Any disputes shall be resolved through:

  1. Good faith negotiation between the parties
  2. Mediation if negotiation fails
  3. Binding arbitration or courts in Vilnius, Lithuania

14. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes via email or platform notification at least 30 days before they take effect. Continued use after changes constitutes acceptance.

15. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and Boottify
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect
  • Waiver: Failure to enforce any right does not constitute a waiver
  • Assignment: You may not assign these Terms without our consent
